1. Who you are contracting with

ESATify ("ESATify", "we", "us") provides an online ESAT practice platform at esatify.com. By creating an account or continuing to use the service you agree to these Terms & Conditions. If you are under 18, you confirm a parent or guardian is aware of and agrees to your use of the service.

2. The service

ESATify provides practice questions, past paper sections, timed sessions, worked solutions, analytics and related study tools. The Season Pass is a one-time purchase that unlocks unlimited practice, past papers and analytics for the current admissions cycle, through ESAT exam day.

3. Your account

You must provide accurate information and keep it up to date. You are responsible for keeping your login credentials confidential and for all activity that happens under your account.

4. Acceptable use

You must not misuse ESATify. In particular, you must not:

• use the service for anything unlawful, fraudulent or abusive, including spam;
• copy, scrape, redistribute, resell or publish our questions, solutions or other content;
• infringe anyone's intellectual property rights;
• interfere with the security or integrity of the service, including probing, malware or automated scraping;
• share, resell or transfer your account or Season Pass access to anyone else;
• reverse engineer the service or circumvent technical limits such as free daily question limits.

5. Intellectual property

ESATify retains ownership of the platform and all associated intellectual property, including software, original questions, worked solutions, branding and documentation. You receive a limited, non-exclusive, non-transferable right to use the service for your own exam preparation. Past paper material remains the property of its respective rights holders; ESATify is not affiliated with, endorsed by, or connected to Cambridge Assessment Admissions Testing or any university.

6. Content you submit

You keep ownership of anything you submit (for example answers, league names or support messages) and grant us a limited licence to host and process it solely to provide the service.

7. Service availability

We work hard to keep ESATify available and accurate, but we do not guarantee uninterrupted or error-free performance. Predicted scores and analytics are estimates for study guidance only and are not a prediction of, or guarantee about, your actual ESAT result or any admissions outcome.

8. Payment, billing and refunds

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

9. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time and can delete your account from Settings, which removes your practice data.

10. Warranties and liability

To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose. We exclude liability for indirect, consequential or special losses, including loss of profits, data or opportunity. Our aggregate liability is capped at the fees you paid in the 12 months before the claim. Nothing in these terms limits liability for fraud, death or personal injury caused by negligence, or anything else that cannot lawfully be limited.

11. Indemnity

You agree to indemnify us against claims arising from your unlawful use of the service, your content, or your breach of these terms.

12. Changes, law and disputes

We may update these terms; material changes will be notified in the app or by email. These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction. You may not assign your rights without our consent; we may assign ours as part of a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control.
